This is to certify that the Dog known as (Pup #_____________) born __________ hereinafter referred to as "the DOG" was sold to named buyer as Show Potential or Breeding Potential or Companion quality, for the total sum of ($________.00), receipt of which is hereby acknowledged. The DOG is a purebred Australian Shepherd, sired by (___________________ ), and out of (_________________________). Registration papers or application with the ___________________________________________club are included with the purchase OR will be mailed as soon as they are received from the Registering Organizations.
BUYER UNDERSTANDS THAT PAYMENT IS DUE AT THE TIME BUYER TAKES POSSESSION OF THE DOG OR, IF BEING SHIPPED, PRIOR TO SHIPPING DATE. PAYMENT BY CHECK (ACCEPTED ONLY FOR DEPOSIT) BALANCE DUE IN CASH (CHECK ACCEPTED IF RECEIVED TEN DAYS PRIOR TO SHIPPING OR PICK UP) MADE PAYABLE TO HEATHER HAMERSKI.
BUYER AND SELLER AGREE TO THE FOLLOWING PROVISIONS OF THE SALE:
The seller guarantees that the DOG is in good health, free of known contagious diseases and has had vaccination(s) required for its age at the time of this agreement. The Buyer has the option to have the DOG examined at their own expense by a licensed veterinarian within 5 days of receipt of the DOG. If the DOG is determined to be in poor health, as evidenced by a veterinarian's statement, the Buyer can elect to keep the DOG, assuming all costs for its future medical/Physical care, or may return the DOG for a full refund upon the Seller's receipt of the veterinarian's statement regarding the DOGS ill health. This provision will expire 5 days after Buyer takes possession of the DOG.
The Buyer certifies, by signing this agreement, that the DOG will live with the Buyer, be confined by a secure, fenced yard and will have adequate exercise, nutritious food and necessary health care from a licensed veterinarian, including all vaccinations and thereafter annual check ups and needed vaccinations. We Do Not Guarantee: roundworm, tapeworm, hook or whipworm removal, as this is normal routine puppy care. We also do not cover coccidia, giardia, parvo etc. as these conditions are not considered hereditary or congenital.
The Buyer also certifies, by signing this agreement, that he/she is not acting as an agent in this purchase, that the Buyer will not resell this DOG or any of its' offspring to a pet store, guard dog business or medical research facility. Seller guarantees a Breeding Potential DOG against any inheritable/genetic defects which are attested to by veterinary reports to the age of one and a half years old including hip dysplasia (Orthopedic Foundation for Animals (OFA) report and genetic eye defects (Canine Eye Registration Foundation (CERF) report.
The guarantee will be null and void for any of the following reasons:
1. Seller shall not be held responsible for the development of non-genetically derived disqualifying faults, diseases or disorders that are due to Buyer's negligence.
2. Seller makes no guarantee regarding loss of the DOG due to accidental death, or theft.
Shipping or miscellaneous charges associated with transport of replacement puppy will be the Buyer's responsibility.

TEMPERAMENT
Seller strongly recommends that Buyer attend puppy, conformation or obedience classes with Dog and provide proper socialization for puppy. Seller will not guarantee temperament if said Dog is secluded and un-socialized.
CLASSIFICATIONS:
Show Potential is defined as a "pick puppy" that has the potential to be shown and titled in any competitive show venues, including, but not exclusively limited to one or more of the following: conformation, obedience, agility, herding, tracking and any other acceptable competitive venue. The seller does not guarantee that said dog will win/place/qualify in any show events.
Breed Potential is defined as a puppy that has the potential to develop into a dog of sufficient merit and would not be precluded from breeding to a like or better dog.
Companion Quality is defined as a puppy that may have a disqualifying fault at time of birth or other shortcomings that precludes showing and/or breeding. Said fault will not prevent the puppy from living an otherwise normal and healthy life. Seller will check limited registration/not for breeding on registration applications as needed. The DOG is warranted only for the purpose of being a companion animal. While it may be capable of performing other functions, no warranty is given as to its fitness for any special purpose.
GENERAL
Before any guarantees will be honored, Buyer must provide Seller with statement from veterinarian, on veterinarian letterhead, stating the health condition and the genetic origin of health condition of said Dog. Seller reserves the rights to have a veterinarian of his or her choice evaluate the DOG'S condition, at Seller's expense, before the guarantee will be honored, except in the case of OFA evaluated hip x-ray. Seller will honor guarantees with either 1.) refund for the purchase price at time of original sale or 2.) Return puppy for a different dog of equal or lesser value directly related to availability. This is the maximum guaranty/warranty provided by the original seller with no other warranties expressed or implied.. Any future medical care is the responsibility of the buyer. Seller retains right of first refusal if at any time in the life of the DOG the Buyer is unable or unwilling to keep the DOG. If Buyer desires to sell the DOG, Buyer agrees to contact Seller and allow Seller the first opportunity to purchase the DOG. If Seller exercises the right of first refusal and takes the DOG back with the intention of selling the DOG to another Buyer. Seller also retains right of first refusal to take the DOG back should Buyer wish to place the DOG in a new home, but does not wish any money back. If Seller declines to exercise the right of first refusal, either to purchase the DOG back or take the DOG back with no monies exchanged. If Buyer finds a new home for the DOG, Buyer agrees to provide Seller with the name, address and phone number of the new owner. Seller makes no guarantees regarding finding a new home for the DOG, but will make its best efforts to assist Buyer with finding a new home. Under no circumstances will the buyer ever place this DOG into a Animal shelter or pound.
The Sales Contract is non-transferable. A copy of this Sales Contract shall be as valid as the original. In the event of a dispute, the State of California, County Of RIVERSIDE, will have jurisdiction over the matter.

CONDITIONS OF SERVICE
The stud service fee is payable in full at the time of the first breeding unless otherwise specified in the initial agreements for the breeding. (*) i.e. - The owner of the stud dog shall select a stud fee puppy in lieu of cash when litter is 5 weeks old. Individual arrangements will be made in writing between the owners of the stud dog and the owner of the Dam.

2. A “live” litter is guaranteed. Two live puppies living to one week of age is considered a “live” litter.
3. If the Dam fails to whelp, the owner of the Dam must notify the stud dog owner within ten days of the whelping due date. A return service will be given by the stud dog described above to the Dam described above.
4. All transportation expenses are the responsibility of the owner of the Dam. By air freight or ground prepaid to a designated location determined by the stud owner; Heather Hamerski
5. It is understood that the owners of the stud dog shall maintain responsible care of the Dam while at the stud dog owners facility. It is also understood that the owner of the Dam will assume all costs incurred by the owner of the stud dog for any medical treatment by a veterinarian required for the Dam while under the supervision of the owner of the stud dog.
6. In case of an AI breeding, (artificial insemination) all costs incurred by the owners of the stud dog will be charged to the owner of the Dam. This includes but is not limited to : ovulation timing tests, semen collection and shipping costs.
7. Any Dam that cannot be bred due to viciousness or any other extreme behavior problem will be returned to the owner with the stud fee payment.
8. It is the responsibility of the owner of the Dam to advise the owner of the stud dog of any habits, behavioral problems and/or medical conditions of the Dam described above.
9. The owner of the Dam shall furnish the owner of the stud dog the following information from a state certified veterinarian prior to breeding :
a. Copy of the AKC/Club registration papers/Pedigree/Picture.
b. OFA hip certification is essential for dogs 2 years or older.
c. Current immunization /worming records/other health clearances.
d. Expectable Conformation, AKC guide lines
e. Dam must be at least 1 year or older and after her first heat.
10. In the event that the owner of the stud dog chooses to take a puppy in lieu of a stud fee, the owners of the stud dog reserve the right to withhold the signing of the AKC litter registration until said puppy is in possession of the stud dog owner.
